The Demitri Team is an agent or collection of agents operating under John A Demitri Jr LLC, a Florida limited liability company, and affiliated with the eXp Realty LLC brokerage. These Terms of Use (“Agreement”) govern your access to and use of the websites, services, and other online platforms operated by us (collectively, the “Services”).

We may update this Agreement from time to time. Continued use of the Services after changes are posted constitutes your acceptance. We reserve the right to modify or discontinue parts of the Services at any time.

We grant you a limited, revocable, non-exclusive license to use the Services for personal use only. All rights, title, and interest in the Services remain with us and/or our licensors.

You may be required to register an account. You are responsible for safeguarding your credentials and all activities that occur under your account.

By using the Services, you agree to receive communications from us, including via email, phone calls, and texts (including automated and/or pre-recorded messages), unless you opt out.

4. Privacy and Data Collection

You acknowledge and agree to our data collection practices, including usage tracking and the sharing of data with our affiliated entities and service providers, consistent with our Privacy Policy. Any information collected will be used in accordance with applicable law.

5. User Conduct

You agree not to:

Upload or transmit harmful code or malicious software.

Misrepresent your identity.

Interfere with the operation or security of the Services.

Use data scraping or automated tools without permission.

6. Third-Party Services

We may link to or integrate third-party services. We are not responsible for third-party content, functionality, or privacy practices.

7. AI & Automation Disclaimer

If you use AI-driven features provided via the Services, you understand that results may be inaccurate or incomplete. It is your responsibility to verify any AI-generated output.

8. Transactions and Payments

You may be able to purchase services or subscriptions through our platform. By doing so, you authorize us to charge your selected payment method. All sales are final unless otherwise stated.

9. Submissions and Feedback

Any feedback or content submitted by you (e.g., reviews, comments, ideas) becomes our property and may be used for any purpose.

12. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed fifty dollars ($50.00) or the amount you paid us in the past 12 months.

13. Indemnification

You agree to indemnify and hold harmless The Demitri Team, John A Demitri Jr LLC, eXp Realty LLC, and their respective agents, from any claims or liabilities arising from your use of the Services.

14. Termination

We may suspend or terminate your access at any time without notice. Provisions intended to survive termination (e.g., liability, indemnification, IP rights) shall remain in effect.

15. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Florida. Any disputes will be resolved through good faith negotiations, and if necessary, binding arbitration in West Palm Beach, Florida, under the rules of the American Arbitration Association. You waive any right to class action or jury trial.

16. Export and International Use

You are responsible for compliance with all local laws and U.S. export regulations. We make no representation that the Services are appropriate for use outside the U.S.

17. Miscellaneous

This Agreement is the entire agreement between you and us. If any part is deemed invalid, the remainder remains in effect. Our failure to enforce a right is not a waiver.
